Fed: Hollywood star in High Court
By Cathy Alexander
CANBERRA, Aug 29 AAP - Australia's top judge was farewelled today by the cream of the
legal community - and the Incredible Hulk.
Chief Justice Murray Gleeson marked his retirement from office with a formal ceremony
at the High Court in Canberra.
Amid the rows of bewigged lawyers and judges sat Hollywood star Eric Bana, who is perhaps
better known for playing Mark "Chopper" Read and the Hulk than he is for his real-life
role as Chief Justice Gleeson's son-in-law.
Chief Justice Gleeson, nicknamed "the Smiler" for his serious manner in court, did
not seem to mind as his famous relative stole the limelight on his last day.
In fact, Chief Justice Gleeson found it hard to keep the rarely-seen smile off his
face after the ceremony as he mingled with well-wishers, including former prime minister
John Howard, who hired him back in 1998.
The atmosphere inside the courtroom was more ceremonial as the full bench of the High
Court flanked their outgoing boss.
He was commended as a stalwart defender of the independence of the judiciary, a "quick
and deadly" legal practitioner - and a source of the occasional dry wit.
Ross Ray, president of the Law Council of Australia, said Chief Justice Gleeson had
seen off any attempts by outsiders to dominate the court.
"Judicial independence and the supremacy of law are central to your philosophy of law
- and shine through in all you have done and written," Mr Ray said.
He recalled Chief Justice Gleeson's prowess on the tennis court, noting many junior
lawyers worked out it was wisest to lose.
Attorney-General Robert McClelland said Chief Justice Gleeson had made a substantial
mark on Australia's legal system.
"You have worked to strengthen judicial institutions and the sense of a national judicial
identity," Mr McClelland said.
For his part, Chief Justice Gleeson stuck with his modus operandi of avoiding activism
and political statements.
"It has been a great privilege to serve as chief justice of this court and of Australia,"
he told the ceremony.
He spoke of the importance of "a spirit of independence" among the legal profession.
He praised the formation of a sense of national identity within the judiciary, helped
by various organisations, colleges and conferences which had been created during his career.
Chief Justice Gleeson will be replaced by Federal Court judge Robert French, who takes
office on Monday.
"I extend to him my warmest wishes for a happy and successful term of office," Chief
Justice Gleeson said.
He must leave office today because he turns 70 tomorrow - and the Constitution says
High Court judges must retire when they turn 70.

Fed: Police arrest 24 in nationwide child porn investigation
By Peter Veness
CANBERRA, Dec 20 AAP - They are the criminals that criminals despise.
Police today announced they had arrested 24 men who had downloaded photos of babies
and children being tortured.
The torture included rape.
Investigators in Western Australia, NSW, South Australia, Queensland and Victoria along
with federal police have been working for 11 months on Operation Irenic - today was the
first the public had heard of the work.
Police seized millions of images on hard drives and CDs, downloaded from predominantly
US-based websites, when they arrested the men who ranged in age from 30 to 70.
Kevin Zuccato heads the federal high tech crime operations office which is leading
the hunt for paedophiles and those who view child pornography.
He says the profile of these alleged criminals is impossible to pin down.
"This is a worldwide phenomenon.
"We see individuals who come from all walks of life. It's very difficult to categorise
them at all," Mr Zuccato told reporters in Canberra today.
"We had forensic psychologists, we had a person that worked in a television station,
we had teachers, an RSPCA worker, an ex-police officer (and) we had a retired person."
The children caught up in this abuse are diverse as well, causing headaches for those
trying to free them.
"They are caucasian, asian ... identifying exactly where they're from is an issue that
we're working with our international colleagues on."
At least one is Australian and authorities have removed the child from harm. Mr Zuccato
said police believe the child was being groomed for abuse.
These arrests are only the beginning if the amount of intelligence gathered by Operation
Irenic is any indication.
"If we've seized over one million images alone from the people that we've arrested
over the last month and that there were over 6,000 IP addresses identified in the Interpol
investigation, the number of images must number in the several millions and obviously
they're being shared," Mr Zuccato said.
IP addresses are the addresses of individual computers logged onto the internet and
can be changed or masked to avoid detection.
America's Federal Bureau of Investigation has been heavily involved in the hunt and
Mr Zuccato hinted there may be arrests in the US as the operation continues.
"With these types of investigations we don't stop at just arresting the people who
download the images," he said.
"Our main objective is to identify everybody that we possibly can (who is) involved
in these type of offence."
The investigation is global.
"We are networked, we are trying to move as fast as we possible can to ensure that
we save children.
"There will be arrests internationally."
As the work of hunting these people continues, the officers involved must keep viewing
sickening images and pretending to befriend people who Mr Zuccato describes as having
"sick fetishes and predilections".
"The men and women who are involved in this type of work, not only from a law enforcement
perspective but from NGOs and other government departments, I think, do one of the hardest
jobs that there is in law enforcement.
"What you will see is no greater commitment or passion to ensure that we identify who
is committing these offences and in particular when we identify a child at risk and save
that child (there is) no greater elation.
"I don't think there's any greater honour as a law enforcement officer than working
on this type of investigation."

Fed: ASIC action shouldn't affect compo package: ACTU
MELBOURNE, Feb 15 AAP - Unions don't expect civil legal action launched by the corporate
watchdog against James Hardie to affect the compensation package for asbestos victims.
The Australian Securities and Investment Commission (ASIC) is suing the building products
giant plus 10 current and former executives and directors for allegedly misleading investors
over its compensation payouts for asbestos disease victims.
ACTU secretary Greg Combet said the legal action in the NSW Supreme Court should not
affect last week's decision by the company's shareholders to approve a $4 billion compensation
payout for people diagnosed with asbestos-related diseases.
"We're very confident that the proceedings that have been launched by ASIC will not
disturb the proper implementation and pursuit of the compensation fund and further payments
to be made by James Hardie," Mr Combet told reporters in Melbourne.
"We believe that James Hardie is committed to the deal that has been implemented," he said.
Mr Combet said the action by ASIC today vindicated a union campaign against James Hardie
which eventually led to the company implementing a compensation package for asbestos disease
victims.
"We are not surprised by the announcement by ASIC because, obviously, when James Hardie
restructured some years ago we were very apprehensive and concerned that the affect of
the restructuring, of course, was to deny people their access to compensation," he said.
"We were concerned at the time, and subsequently, that there may have been breaches
of the Corporation's Act in the process of that restructuring.
"I think it vindicates ... the campaign that we ran and, ultimately, we were able to
secure a compensation settlement."

NSW: Helicopter hijacker wins freedom: report
SYDNEY, April 23 AAP - A gun-toting librarian who hijacked a helicopter to spring her
lover from a maximum security Sydney prison in 1999 will be set free next month.
The NSW State Parole Authority has decided to grant Lucy Dudko parole on May 8 after
model behaviour behind bars at Silverwater jail and because she is a first-time offender,
The Sun-Herald reports.
But she has been banned from visiting her lover, serial armed robber John Killick,
who is serving 23 years in Lithgow jail.
The earliest the "Bonnie and Clyde" couple can be reunited is 2013 when, at age 71,
Killick can seek parole.
In a strange twist, his former wife, Gloria, had been visiting the Moscow-born Dudko
regularly in prison.
Ms Killick, who was estranged from her husband, struck up an unlikely friendship with
the Russian mother-of-one -- helping her with her English and taking her in when Killick
was locked up for bank robbery.
"They formed a really close bond and it helped Lucy regain her life," a family friend
told the newspaper.
Yesterday, Ms Killick confirmed from her home in Sydney's Milson's Point she was still
in touch with Dudko, who turns 48 tomorrow.
But she told The Sun-Herald she was not aware of the parole conditions and did not
know where Dudko would be living on release.
Dudko had made inquiries about hiring a helicopter and had hired prison escape videos
before she helped stage the most dramatic escape in Australian penal history seven years
ago.
She forced a helicopter pilot to fly at gunpoint to the exercise yard of the nation's
biggest maximum security jail to free Killick.
After six weeks on the run, the lovers were captured in a Sydney caravan park.
